Supreme Court Nominee Elena Kagan Accused of Plagiarism Scandal Whitewash While Dean at Harvard Law School

I will continue investigating this story to see if it is true. If it is true, then Ms. Kagan's actions (or inactions) in this alleged whitewash need to be considered in the Supreme Court nomination process.

Supreme Court: Kagan Accused of Plagiarism Scandal Whitewash

WASHINGTON - April 26 - Solicitor General Elena Kagan is widely reported to be the leading contender for the Supreme Court position being vacated by John Paul Stevens.

While Kagan was dean of Harvard Law School, several law faculty plagiarism scandals surfaced. Lawrence R. Velvel, dean of the Massachusetts School of Law, wrote about much of this and called for Kagan's departure at the time.

Velvel accused Kagan and Lawrence Summers (who as president of Harvard appointed Kagan) of a "whitewash that avoids punishing a celebrity star professor" for their handling of the revelations that a book by University Professor Laurence Tribe had passages identical to those in a book by University of Virginia Professor Henry J. Abraham.

Wrote Velvel: "Harvard University is now probably the only school in the country with a University Professor who is an admitted plagiarist." This followed a similar scandal involving Professor Charles Ogletree; Velvel noted at the time: "Ogletree admitted that in a recent book he plagiarized over 800 words from another book."

Both Tribe and Ogletree taught Obama at Harvard; Tribe is now senior counselor for access to justice at the Department of Justice. Summers -- who is now director of the National Economic Council -- resigned as president of Harvard University in early 2006 following a no-confidence vote by Harvard faculty.

See Velvel's piece from 2005: "Re: Larry Tribe, Larry Summers and Elena Kagan: Because of the Larry Tribe Affair, It Is Time for Larry Summers to Go."

Visa Credit Card Company Warns of Imminent Fraud Attack from Eastern Europe Criminal Group

More and more cyberattacks from all over the map. Visa is the likely next victim - or at least it believes so.

Visa is warning financial institutions that it has received reliable intelligence that an organized criminal group plans to attempt to move large amounts of fraudulent payments through a merchant account in Eastern Europe, possibly as soon as this weekend.

In an alert sent to banks, card issuers and processors this week, Visa said it “has received intelligence from a third-party entity indicating that a criminal group has plans to execute “a large batch settlement fraud scheme.”

FLASHBACK: Elena Kagan Moderates Gun Control & 2nd Amendment Debate at Harvard University (2003)

This article is from 2003. You can read the full story at the Harvard Crimson web page. This is all I have found so far regarding Ms. Kagan and her position on the Second Amendment.

The Second Amendment deserves a B-minus in draftmanship, according to Frankfurter Professor of Law Alan Dershowitz, who debated the constitutional issues surrounding gun ownership at Harvard Law School (HLS) last night.

In front of an audience of about 200, Dershowitz advocated heavy regulation of gun purchases, saying that the amendment would prevent guns from being banned altogether.

Joining him in debating were Dennis Henigan, director of the Brady Center to Prevent Gun Violence’s Legal Action Program, and Eugene Volokh, a professor at UCLA School of Law. Elena Kagan, an HLS professor chosen last week to be the school’s new dean, moderated the debate.

India's Government Plans Annual Mock Cyber Attacks to Shield Against Hackers

Cyber attacks are the new H1N1. It is the latest thing introduced by the mainstream media to instill fear in the populace. Yes, cyber attacks can and will likely occur. However, the reason they occur is because the government is either too lazy, complicit or otherwise to fix the vulnerable holes in its networks. The government also does not have a hand on enterprise architecture software which can take control of a computer without leaving a trace. Why are vulnerable government networks connected to the very insecure Internet?

India is getting into the mix too and will be conducting annual mock cyber defense exercises similar to the Cyber Storm exercises here in the United States of America.

The government is planning to conduct mock cyber war games every year, unleashing malicious mock attacks on computers of critical establishments like defence, telecom companies, airlines, banks and railways to prepare the nation against a cyber war. The move to have mock cyber wars comes in the wake of increased attacks by Chinese hackers on computers of major defence establishments in India, last year.

Leaked Report Reveals That U.S. Government Fears Deepwater Horizon Oil Well Could Become Unchecked Gusher

Uh-oh, what happens if BP cannot close this oil well? Also, what happens if the wellhead is lost and the oil gushes out a maximum rate? It appears that the government has some of these same fears per a recent leaked report.

A confidential government report on the unfolding spill disaster in the Gulf makes clear the Coast Guard now fears the well could become an unchecked gusher shooting millions of gallons of oil per day into the Gulf.

Depository Trust and Clearing Corporation Risk Officer Warns Securities Conference Attendees Moments Before Nearly 1,000 Point Dow Plunge

I don't know if this means anything, because perhaps this guy was just lucky. Nevertheless, an officer at the DTCC warned securities conference attendees how the Greek crisis could lead to widespread panic in the financial markets. Moments later, the market dropped by nearly 1,000 points in a matter of minutes.

Shortly after the chief systemic risk officer of the Depository Trust and Clearing Corporation warned attendees at a securities operations conference Wednesday that Greece's crisis was a systemic problem, the Dow plunged almost 1,000 points.

Even if the "warning" means nothing, it gives me a chance to introduce The Depository Trust and Clearing Corporation to this blog. In case you have never heard of this entity, here is some initial information per the DTCC company website. I'll write additional information as I get more and more relevant stories.

About DTCC

DTCC, through its subsidiaries, provides clearance, settlement and information services for equities, corporate and municipal bonds, government and mortgage-backed securities, money market instruments and over-the-counter derivatives. In addition, DTCC is a leading processor of mutual funds and insurance transactions, linking funds and carriers with their distribution net-works. DTCC's depository provides custody and asset servicing for more than 3.6 million securities issues from the United States and 121 other countries and territories, valued at US$33.6 trillion. In 2009, DTCC settled more than US$1.48 quadrillion in securities trans-actions. DTCC has operating facilities in multiple locations in the United States and overseas.

FLASHBACK: Barack Obama is Top Recipient of BP-Related Donations During 2008 Election Cycle

This is an interesting tidbit to consider when the government finally imposes its penalty onto BP for the Deepwater Horizon oil spill in the Gulf of Mexico.

During the 2008 election cycle, individuals and political action committees associated with BP -- a Center for Responsive Politics' "heavy hitter" -- contributed half a million dollars to federal candidates. About 40 percent of these donations went to Democrats. The top recipient of BP-related donations during the 2008 cycle was President Barack Obama himself, who collected $71,000.

Nalco Uses COREXIT® 9527 Oil Dispersant to Combat Deepwater Horizon Oil Spill in Gulf of Mexico

The article continues below...

***For further reading, click the following link: Exxon Report on Acute Aquatic Toxicity of Corexit 9500, 9527 & 9580 Oil Spill Response Products***

Here is a little information about the chemical that will be sprayed by Nalco into the Gulf of Mexico to break up the oil slick. The theory is the chemical will cause the oil to decompose and fall to the bottom of the sea where bacteria will consume the oil. The balance in nature will be restored - or so that is the hope.

If you click the above pictures and links, you can read the product sheet and the safety data sheet.

According to the safety data sheet, COREXIT is a hazardous substance. Does anyone know what effect(s), if any, this chemical will have on the Gulf of Mexico?

Nalco (NYSE:NLC), confirmed today it is providing oil dispersants and support to BP and the responders dealing with the oil spill in the Gulf of Mexico. The company will continue to provide these dispersants as requested for as long as responders have the need.

“To date sales related to these dispersants have not had a material financial impact on our company,” said Nalco Chairman and CEO Erik Fyrwald. “But it is impossible to predict at this time how long this incident will last or the magnitude of the overall response needed.”

U.S. Farmers Demonstrate Use of Hay to Clean Up Deepwater Horizon Oil Spill in Gulf of Mexico

This is such a great video. Why is BP having such a hard time cleaning up this oil when these CW Roberts employees demonstrate what appears to be quite an easy way to clean up the mess? I would much rather be dropping hay into the Gulf of Mexico instead of dangerous proprietary chemicals.

Exxon Valdez is Now An Ore Carrier Vessel Renamed Dong Fang Ocean

In light of the recent explosion, collapse and oil emission of the destroyed Deepwater Horizon complex, I remember back to the Exxon Valdez in Prince William Sound, Alaska in 1989. While there is no doubt to the devastation brought by the Exxon Valdez, it is interesting that the Exxon Valdez is not even in the Top 10 of worst oil spills ever. I would have expected the Exxon Valdez to have least been in the Top 5.

As I thought about the Exxon Valdez, I wondered whatever happened to the tragic ship? Was the ship rusting in some yard of hulks? Was it still delivering oil for Exxon or other oil countries?

Nope, the Exxon Valdez has been renamed a few times, but it is now an ore carrying ship called the Dong Fang Ocean. The above picture is the Dong Fang Ocean vessel (a/k/a the Exxon Valdez).

From
The Maritime:

In 2002 it the ship was put in a lay-up status somewhere along a forgotten section of coast near East Asia. The ship was later re-flagged in the Marshall Islands and re-named the Mediterranean. The ship was eventually sold in January of 2008 to Hong Kong Bloom Shipping Ltd. and was re-named the Dong Fang Ocean with the intention to use the ship as an Ore Carrier.

Nearly Five Hundred (500) Barrels of Oil Remain in Alaska's Prince William Sound Region from Exxon Valdez Spill

Just in case you were wondering about the state of affairs in Prince William Sound over 20 years after the infamous Exxon Valdez spill.

An estimated 64 tonnes of oil (approximately 460 barrels) remains in the region, emitting toxins along the once pristine coastline of Prince William Sound. Mostly, it is found in the sea sediments, where the crude oil chemicals continue to hurt birds, fish and mammals.

"We are surprised to see that much and more surprised to see it in a relatively fresh looking toxic state," says Tiller in a worried voice. "If you dig it up in the right spot, it smells and looks exactly like oil."

FLASHBACK: Transocean's Deepwater Horizon Drills World's Deepest Oil and Gas Well (September 2009)

Crews battle the blazing remnants of Deepwater Horizon on April 21, 2010

Like something out of a bad action movie starring LL Cool J and Samuel Jackson. It even has a Hollywood name - Deepwater Horizon. Here is a press release from September 2009.

Transocean's Ultra-Deepwater Semisubmersible Rig Deepwater Horizon Drills World's Deepest Oil and Gas Well

ZUG, Switzerland, Sept. 2, 2009 (GLOBE NEWSWIRE) -- Transocean Ltd. (NYSE:RIG) today announced that its ultra-deepwater semisubmersible rig Deepwater Horizon recently drilled the deepest oil and gas well ever while working for BP and its co-owners on the Tiber well in the U.S. Gulf of Mexico. Working with BP, the Transocean crews on the Deepwater Horizon drilled the well to 35,050 vertical depth and 35,055 feet measured depth (MD), or more than six miles, while operating in 4,130 feet of water.

A photo accompanying this release is available at
http://www.globenewswire.com/newsroom/prs/?pkgid=6568

"This impressive well depth record reflects the intensive planning and focus on effective operations by BP and the drilling crews of the Deepwater Horizon," said Robert L. Long, Transocean Ltd.'s Chief Executive Officer. "Congratulations to everyone involved."

These achievements are the latest in Transocean's history of world and other records dating back to the 1950s. Most recently, the Transocean jackup GSF Rig 127 drilled the industry's longest extended-reach well in 2008 while working for Maersk Oil Qatar AS at 40,320 feet MD with a 35,770-foot horizontal section. The well was drilled offshore Qatar in 36 days and was incident-free.

Transocean also holds the current world water-depth record of operating in 10,011 feet of water set while working for Chevron in the U.S. Gulf of Mexico.

The Deepwater Horizon, placed into service in 2001, is a dynamically positioned ultra-deepwater semisubmersible rig capable of working in water depths of up to 10,000 feet.

Transocean Ltd. is the world's largest offshore drilling contractor and the leading provider of drilling management services worldwide. With a fleet of 135 mobile offshore drilling units plus eight announced ultra-deepwater newbuild units, the company's fleet is considered one of the most modern and versatile in the world due to its emphasis on technically demanding segments of the offshore drilling business. The company owns or operates a contract drilling fleet of 41 High-Specification Floaters (Ultra-Deepwater, Deepwater and Harsh-Environment semisubmersibles and drillships), 26 Midwater Floaters, 10 High-Specification Jackups, 55 Standard Jackups and other assets utilized in the support of offshore drilling activities worldwide.

Why is President Obama Sending S.W.A.T. Teams to Gulf of Mexico to Inspect All Oil Platforms & Rigs?

Shouldn't we be worried about the spill at Deepwater Horizon instead of sending S.W.A.T. to all other oil platforms and rigs? Hmmmmm. I wonder if the media is silent about Deepwater Horizon possibly being the target of a terrorist or state-sponsored attack.
