Wyoming Firearms Freedom Act (HB0095)

Similar to the Firearms Freedom Acts passed in Tennessee, Montana and Utah, Wyoming has joined the dance. The law exempts firearms made in Wyoming from federal regulation.

Legislation asserting that firearms made, sold and kept only in Wyoming are exempt from all federal gun laws is set to become law after it easily cleared the Wyoming Legislature on Wednesday.

Supporters say the bill is mainly a symbolic shove against the federal government, and it remains to be seen whether the fight will carry over to the courts or even to Wyoming streets.

House Bill 95 also adds a criminal element to federal officials who try to enforce a federal order relating to Wyoming firearms.

Any official, agent or employee of the United States government who enforces or attempts to enforce any act, order, law, statute, rule or regulation of the United States government upon a personal firearm, a firearm accessory or ammunition that is manufactured commercially or privately in Wyoming and that remains exclusively within the borders of Wyoming shall be guilty of a misdemeanor and, upon conviction, shall be subject to imprisonment for not more than one (1) year, a fine of not more than two thousand dollars ($2,000.00), or both.
