First, Attorney General Eric "Stedman" Holder wants your guns. Now he wants your speech! Thanks a lot! Aren't there some bankers you could be prosecuting?
The Matthew Shepard Act (officially, the Local Law Enforcement Hate Crimes Prevention Act or LLEHCPA) is currently pending in committee in the 111th Congress. On June 25, 2009, Attorney General Holder became the first ever sitting U.S. Attorney General to testify in favor a pending bill. Holder has stated that passing this bill is one of his "highest personal priorities."
People are worried that the Bill may be used to federalize local law enforcement and to chill free speech. I do not agree with this Bill, but there is an exception in the Bill for the 1st Amendment in Section 8. This may be used to challenge if this Bill gets out of control, but don't necessarily expect a fair trial.
Nothing in this Act, or the amendments made by this Act, shall be construed to prohibit any expressive conduct protected from legal prohibition by, or any activities protected by the free speech or free exercise clauses of, the First Amendment to the Constitution.
